Although the concept of dignity is commonly invoked in clinical care, there is not widespread agreement—in either the academic literature or in everyday clinical conversations—about what dignity means. Without a framework for understanding dignity, it is difficult to determine what threatens patients’ dignity and, conversely, how to honor commitments to protect and promote it. This article aims to change that by offering the first conceptual model of dignity for patients in the intensive care unit. The conceptual model we present is (...) based on the notion that there are three sources of patients’ dignity—their shared humanity, personal narratives, and autonomy—each of which independently warrants respect. The article describes each source of dignity and draws on examples to illustrate how clinician attitudes, actions, and behaviors can either contribute to, or detract from, expressions of respect for patient dignity. U.S. researchers and scholars often point to two legal factors as significant obstacles to the inclusion of pregnant women in clinical research: the Department of Health and Human Services’ regulatory limitations specific to pregnant women's research participation and the fear of liability for potential harm to children born following a pregnant woman's research participation. This article offers a more nuanced view of the potential legal complexities that can impede research with pregnant women than has previously been reflected in the literature. (...) It reveals new insights into the role of legal professionals throughout the research pathway, from product conception to market, and it highlights a variety of legal factors influencing decision-making that may slow or halt research involving pregnant women. Our conclusion is that closing the evidence gap created by the underrepresentation and exclusion of pregnant women in research will require targeted attention to the role of legal professionals and the legal factors that influence their decisions. Leslie’s doomsday argument purports to show that the likelihood of the human race perishing soon is greater than we think. The probability we attach to it, based on our estimate of the chance of various calamities which might bring extinction about (a nuclear holocaust, an ecological disaster, etc.), should be adjusted as follows. If the human race were to survive for a long time, we, livingnow, would be atypical. So our living now increases the probability that the human race (...) will end shortly. In this paper, I criticize some attempts to rebut the argument, and present my own. To facilitate the analysis, I consider a structurally similar problem, the “ShootingRoom.”. (shrink)

Answering important public health questions often requires collection of sensitive information about individuals. For example, our understanding of how HIV is transmitted and how to prevent it only came about with people's willingness to share information about their sexual and drug-using behaviors. Given the scientific need for sensitive, personal information, researchers have a corresponding ethical and legal obligation to maintain the confidentiality of data they collect and typically promise in consent forms to restrict access to it and not to publish (...) identifying data.The interests of others, however, can threaten researchers' promises of confidentiality when legal demands are made to access research data. In some cases, the subject of the litigation is tightly connected to the research questions, and litigants' interest in the data is not surprising. Researchers conducting studies on tobacco or occupational or other chemical exposures, for example, are relatively frequent targets of subpoenas. (shrink)

In Children, Religion and the Ethics of Influence, John Tillson sets out a clear and convincing case for the view that children ought not to be initiated into religious faith by their parents or others with the relevant ‘extra-parental responsibilities’. However, by predicating his thesis on an understanding of illegitimate religious influence that largely equates initiation into faith with the inculcation of a distinctive type of propositional content, I contend that Tillson misses some of the potential harms such initiation may (...) engender. Here I briefly explain why this is a problem before suggesting three ways he might respond to the criticism. (shrink)

A large literature has grown up around the proposed use of 'weak measurements' to allegedly provide information about hidden ontological features of quantum systems. This paper attempts to clarify the fact that 'weak measurements' are simply strong measurements on one member of an entangled pair, and that all such measurements thus effect complete disentanglement of the pair. The only thing 'weak' about them is that the correlation established via the entanglement does not correspond to eigenstates of the 'weakly measured observable' (...) for the component system that is subject to the weak measurement. It is observed that complete disentanglement always occurs, whether post-­‐selection is performed before or after the pointer detection. Assertions in the literature that weak measurements leave a system negligibly disturbed are therefore inaccurate, and claims based on those assertions need to be critically reassessed. (shrink)

This editorial explains the themes of the forthcoming FLaK seminar and how those themes draw on the collective and individual contributions of the articles, interviews and commentaries presented in this issue. At FLaK, we propose to think with others about the kind of ‘kitchen table’ that FLS might provide into the future. How might feminist legal studies—the approach and the journal—best use its food, equipment, techniques, time, space, mood, energy and commitment? How shall FLS scholars and associates make the most (...) of what we have in a room that can sometimes be confining and confusing, yet also exciting and sustaining? How do others engage with the processes and products of our kitchen table? In considering these issues and more, we propose to draw reflexively on feminist legacies of praxis, internationalism and openness, as we stock up and critically reflect on decolonizing techniques, legal know-how, protest and publishing practices. What does it mean to say that ethics committees that provide prospective review of research involving human beings should be “independent”? In the United States, IRBs—which are typically located within and review research protocols at the institution for which most of their members work—cannot really be considered independent. Yet separating the IRB from the research institution may in turn mean less independence from a trial’s sponsors, as this kind of IRB is commercially motivated and paid directly by the sponsor. One (...) possible answer is to create independent IRBs that are not for profit, but how this model would attract financial and administrative support is unclear. (shrink)

The study draws attention to the transfer of management theories and practices from traditional capitalist countries such as the USA and UK to post-socialist countries that are currently experiencing radical change as they seek to introduce market reforms. It is highlighted that the efficacy of this transfer of management theories and practices is, in part, dependent upon the extent to which work-related attitudes and values vary between traditional capitalist and former socialist contexts. We highlight that practices such as Human Resource (...) Management (HRM) and Organization Development (OD) are inextricably associated with conceptions surrounding culture and society, as well as to variables such as job satisfaction and organisational commitment. The main aim of this study is to compare various attitudes and values of employees in traditional capitalist countries and post-socialist countries. On the basis of the findings of an attitudinal survey of (N = 5914) workers in 15 countries we conclude that certain aspects of the attitudes and values of workers in post-socialist countries and traditional capitalist countries differ significantly. Specifically, these differences were found in respect of context-related and job-related attitudes, and also in relation to the importance that the respondents attached to the subject of ethics more generally. The implications of the study are discussed particularly in relation to the transfer of management theory and practices between traditional capitalist and post-socialist contexts. (shrink)

A readable, well illustrated, and often entertaining book surveying the main issues in the controversy over "time-dilation" and the "clock paradox" in Einstein's theory of relativity.

Do we really know the things we think we know? Are any of our beliefs reasonable? Scepticism gives a pessimistic reply to these important epistemological questions - we don't know anything; none of our beliefs are reasonable. But can such a seemingly paradoxical claim be more than an intellectual curiousity? And if it is, can it be refuted? Ruth Weintraub answers yes to both these questions. The sceptical challenge is a formidable one, and should be confronted, not dismissed. The (...) theoretical and practical difficulties it presents - in that the sceptical life cannot be lived, and the doctrine seems self-defeating - are in fact superficial, according to Ruth Weintraub. Her study looks at the sceptical arguments of Descartes, Hume and the ancient Greek sceptic, Sextus Empiricus. The author argues that by drawing on philosophy, rather than science, the sceptical challenge can be answered. _The Sceptical Challenge_ is a bold and original response to scepticism; it represents a new way of looking at the field for philosophers of epistemology. “There is no longer any world,” wrote the late philosopher Jean-Luc Nancy in 1993, and in this paper, the sense of this loss of world is analysed in terms of the modal notions of necessity, impossibility, and possibility. Modal differentiation can illuminate what constitutes the sense of actuality in a world, and hence, what it is that has been lost regarding this actuality of being in a world. Modal thinking does not rely on knowledge of the true state of affairs, (...) nor on having a constant grasp on necessity: modal thinking enables us to discern the actual by way of the relations between necessity, possibility, and impossibility. It is on the basis of these relations that a mode of rethinking actuality is suggested. In order to pursue this line of thought, I rely on Jacques Lacan’s understanding of modalities as writing operations, concentrating mostly on certain sections from his Seminar XXI, wherein he refers to Aristotelian modal logic and mentions the analytic philosopher Jaakko Hintikka. This ternary relation between Aristotle, Hintikka, and Lacan suggests a different outlook on the actual being-such of a world. The being-such of a world, its actuality, is understood as a contingency, a possibility emerging from the relation between what is declared necessary and what is impossible. The paper shows the implications of such a modal understanding of actuality, as demonstrated in Lacan’s view of human sexuality and sexual difference. (shrink)

When asked to contribute to this lecture series, my first thought was to talk about philosophy of biology, a new and increasingly influential field in philosophy, surely destined to have great impact in the coming years. But when a preliminary schedule for the series was circulated, I noticed that no one was speaking on language. Given the hegemony of philosophy of language at mid-century, after ‘the linguistic turn’, this seemed to require comment. How did philosophy of language achieve such status (...) at mid-century, and why is it losing it now? Has the Anglo-American tradition really begun to put the philosophy of language in better perspective? I hope so. Indeed, I will end with suggestions for how to keep it more securely in its proper place. (shrink)

"Die Blutsäule" schreibt er gleichwohl in einem ganz eigenen Deutsch mit vielen Anklängen an die Sprache der Bibel; insofern diese Sprache zugleich die der 'verhassten' Täter bleibt, entsteht eine komplexe Romankonstruktion, deren religiöser wie zeitgeschichtlicher und (...) literarischer Hintergrund rekonstruiert wird. Literary works across cultures are never written in a vacuum. They depict the reality of the society where they are set. With the societal obligation of the writers to serve as righters, especially in Africa, this study attempts a pragmatic inquiry of the state of the Nigerian society as implicitly and artistically painted in Remi Raji’s poetry collection, A Harvest of Laughters. The known literature on Remi Raji’s A Harvest of Laughters have analysed the collection mainly from literary and ideological (...) perspectives. Attention has not been given to the collection from a pragmatic perspective, hence the intervention of this study. Drawing insights from Jacob Mey’s Pragmatic Acts Theory, the study analyses the pragmatic imports in the collection with fourteen randomly selected excerpts across different segments of the collection constituting the data. Data was purposively selected from different poems in the collection. The findings show that the two major discursive issues in the text are the depiction of the government as cruel and the portrayal of the citizenry as victims. The former was conveyed through the practs of oppressing, embezzling and deceiving, while the latter was revealed through the practs of suffering and hoping. The study concludes that pragmatics is a valuable tool in the demystification of texts. (shrink)

During the last decade and a half, Estonia has concentrated predominantly on economic development in its narrowest sense. Currently, the emphasis is gradually moving towards a broader approach, including an increasingly social agenda. The research question here concerns the awareness of corporate social responsibility among Estonian owners and managers. Empirical research in Estonia indicates that there has been a shift towards recognizing the importance of social responsibility, but this primarily concerns the “lower layers” of social responsibility, recognizing the importance of (...) economic responsibility and in some respects also public responsibility. Responses in interviews show a certain amount of personal initiative, but these are single examples rather than a general trend and are not enough to change the overall picture. Still, in any assessment of the current situation regarding social responsibility in Estonia, emphasis should be laid on the fact that changes are taking effect and will continue to do so. In transition economies, including Estonia, we should not overlook the fact that, at least in the early years of transition, the focus is on a rapid economic development where the social side will inevitably be left in the background and economic development will take place at the expense of social and environmental development. It is argued that if the non-unitary measurement transition, as codified by Von Neumann, is a real physical process, then the ‘probability assumption’ needed to derive the Second Law of Thermodynamics naturally enters at that point. The existence of a real, indeterministic physical process underlying the measurement transition would therefore provide an ontological basis for Boltzmann’s Stosszahlansatz and thereby explain the unidirectional increase of entropy against a backdrop of otherwise time-reversible laws. It is noted that the Transactional Interpretation of quantum (...) mechanics provides such a physical account of the non-unitary measurement transition, and TI is brought to bear in finding a physically complete, non-ad hoc grounding for the Second Law. One important and consistent thread of Charles Taylor’s thought that has not yet received the attention it deserves is his philosophy of freedom. Taylor’s 1979 defense of positive liberty in response to Isaiah Berlin’s “Two Conceptions of Liberty” is, of course, well known. But there is a way of seeing reflection on freedom as a thread that runs, sometimes silently but always significantly, through his whole body of work. Taylor can be seen as asking what freedom means, how many varieties (...) it has, what it (or they) require, how it (or they) are supported and promoted, or threatened and diminished. Throughout his work, Taylor tacitly encourages us to think about what types of freedom are possible and desirable for embodied entities. (shrink)

This article analyses the nature of trust involved in mentoring ex-prisoners. Literature outlines understandings of well-placed trust as dependent upon the motivations of the trust parties, placed in those who are perceived to be trustworthy, or placed in those who have the potential to be trust-responsive. This article describes how faith-based volunteer mentors’ motivations to serve God rather than save man facilitated their bestowal of unearned trust on their ex-prisoner protégés and how this gift of trust was capable of potentiating (...) a trustworthy response. It also describes how this proactive trust was well-placed in some who failed to be trustworthy because it encouraged open and honest communication of this failure. As a result, it argues in some circumstances it could be intelligent to place trust proactively without evidence of trustworthiness, and that trust of this kind could be especially important to people released from prison. We respond to two themes in the comments by Bainbridge, Gratch, and Nishida: first, the importance of embodiment, and second the issue of what should be explicitly modelled as against what should be dynamically generated. Finally, we briefly respond to the ethical questions raised by Bainbridge.

This book conveys an understanding of China’s educational development from within and provides unique insights into Chinese society. It does so through portraits of eleven influential educators whose ideas have shaped the educational reforms initiated by Deng Xiaoping in 1978. The book makes Chinese civilization concrete through the drama of the real lives of educators and provides glimpses into the educational context of China’s recent move onto the world stage.

Spiritual practices such as prayer have been shown to improve health and quality of life for those facing chronic or terminal illness. The early Christian healing tradition distinguished between types of prayer and their role in healing, placing great emphasis on the healing power of more integrated relational forms of prayer such as prayers of gratitude and contemplative prayer. Because autonomic tone is impaired in most disease states, autonomic homeostasis may provide insight into the healing effects of prayer. I report (...) on observations in five volunteers engaging in five types of prayer. Using heart rate variability as a measure of autonomic tone and adaptability, I review the potential correlation of type of prayer with autonomic rebalance as measured specifically by psychophysiological coherence ratios. The five types—supplication, devotion, intercession, gratefulness, and contemplative prayer—elicited varying degrees of improvements in heart rate variability and corresponding psychophysiological coherence. These observations suggest a correlation of innate healing to prayer type that is consistent with teachings from the Christian healing tradition and with modern research. Further research is warranted to verify these hypotheses. (shrink)
